KΛTIKN provides an AI-powered conversational platform that enables businesses to:

• Manage customer conversations through messaging platforms
• Automate responses using AI agents
• Qualify leads
• Schedule appointments
• Integrate with third-party services such as WhatsApp Business API and calendars

The Service is intended for business and professional use.

2. User Accounts

To access certain features, you may be required to create an account. You agree to:

• Provide accurate and complete registration information
• Keep your login credentials confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities under your account

KΛTIKN is not responsible for losses caused by unauthorized access due to your failure to secure account credentials.

3. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Send spam, unsolicited marketing, or abusive communications
• Harass, threaten, or harm individuals
• Distribute malware, viruses, or malicious software
• Attempt to gain unauthorized access to systems or data
• Interfere with the proper functioning of the Service

KΛTIKN reserves the right to suspend or terminate accounts that violate these rules.

4. Third-Party Integrations

KΛTIKN may integrate with third-party services including but not limited to WhatsApp Business API, messaging platforms, calendar systems, and CRM tools. Use of these integrations may require compliance with the third party’s Terms of Service, Privacy policies, and Platform policies. KΛTIKN is not responsible for the availability or reliability of third-party services.

5. WhatsApp & AI Tracking Agreement

By connecting a WhatsApp account, you grant KΛTIKN the following authorizations:

• KΛTIKN is authorized to access, track, and record inbound and outbound WhatsApp message content to enable AI responses.
• The system will automatically extract contact details from new inbound messages to create a Lead record.
• Active agents will respond to inquiries.
• Users may "Take Over" any tracked conversation, which automatically pauses AI responses while preserving the full chat context.

6. AI Usage Policy

This policy governs the behavior of the OpenAI-driven intelligence within the Service:

• AI responses are strictly limited to the information provided in the agent's associated Knowledge Base to ensure accuracy.
• The AI is authorized to ask required qualification questions and calculate a Lead Score via a scoring engine.
• Users may not configure AI personas to generate harmful, offensive, or inappropriate content.

7. AI-Generated Content

KΛTIKN uses artificial intelligence to generate automated responses and manage conversations. While we strive for accuracy:

• AI-generated responses may not always be accurate or appropriate.
• Users remain responsible for monitoring communications where necessary.
• KΛTIKN does not guarantee the correctness or completeness of AI outputs.
• The Service should not be relied upon for legal, financial, or professional advice.

8. Data and Customer Information

Users may submit or process customer data through the platform. You represent that you have the lawful right to process such data and you comply with applicable privacy laws and messaging regulations. KΛTIKN processes this data in accordance with its Privacy Policy.

9. Fees and Billing

Certain features of the Service may require payment. By subscribing to a paid plan, you agree to pay all applicable subscription fees, provide valid billing information, and allow recurring billing where applicable. Failure to pay may result in suspension or termination of your account. All fees are non-refundable unless otherwise required by law.

10. Intellectual Property

All intellectual property rights related to the Service, including software, AI models, platform design, branding, and documentation are owned by KΛTIKN or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

11. Data Ownership

Users retain ownership of the data they upload or process through the platform. By using the Service, you grant KΛTIKN the right to process, store, and analyze data for the purpose of operating and improving the Service.

12. Service Availability

We aim to provide reliable service but do not guarantee uninterrupted availability. KΛTIKN may perform maintenance, modify platform features, or temporarily suspend the service without prior notice when necessary.

13. Limitation of Liability

To the maximum extent permitted by law, KΛTIKN shall not be liable for indirect or consequential damages, loss of profits or revenue, loss of data, or business interruption arising from the use or inability to use the Service.

14. Indemnification

You agree to indemnify and hold harmless KΛTIKN from any claims, damages, or losses arising from your use of the Service, your violation of these Terms, or your violation of applicable laws or regulations.

15. Termination

KΛTIKN may suspend or terminate your account if you violate these Terms, fail to pay required fees, or if your use of the Service poses a security or legal risk. Upon termination, your right to use the Service will immediately cease.

16. Changes to the Terms

We may update these Terms from time to time. When changes occur, we will update the Last Updated date and publish the updated Terms on our website. Continued use of the Service after updates constitutes acceptance of the revised Terms.
